USAGE POLICY
Coastal Computing has a responsibility to protect each of our clients and
provide the best service possible. The Coastal Computing customer is expected
to have a basic knowledge of how the Internet functions, the types of
use which are generally acceptable on the Internet, and the types of
use which are to be avoided. Common sense is the best guide as to what
is considered acceptable use. Also common sense is the rule when uploading
files during high traffic usage times on the Internet. Inland
Computing offers
space for your site on our servers and has nothing to do whatsoever
with your access to reach our servers or the time it takes to upload,
etc. The following guidelines were designed to ensure these services.
CONTENT
Illegality
In any form, including but not limited to the unauthorised
distribution or copying of copyrighted software or other data,
harassment, fraud, trafficking in obscene material.
Undesirable Content
Certain types of content are not allowed on our network. We do not
host adult content of any description. Content relating to Hacking,
Cracking, Warez and IRC is not allowed. Software downloads may only
be hosted if you are the writer and copyright owner of the software,
all other software including freeware, shareware and trial software
is forbidden.
The hosting of Audio and Video related content of
all nature are forbidden unless permission is sought first from
Support.
A few examples
of non-acceptable content or links are:
- pirated software
- hacker's programs or archives
- warez sites
- mp3 archives
Coastal Computing will be the sole arbiter as to what constitutes a violation
of this provision.
SERVER RESOURCES
Any web site that uses a high amount of server resources (such as
CPU) will be given an option of either paying extra (which depends on
the resource needed) or reducing the resource needed to an acceptable
level. Misuse of system resources, including but not limited to employing
posts or programs which consume excessive CPU time or storage space,
permitting use of mail services, mail forwarding capabilities, POP accounts,
or auto-responders other than for the customer's own account, resale
of access to CGI scripts installed on Coastal Computing's servers, or attempting
to use a single customer account for third party web sites by allowing
more than one domain pointer to be used to reference pages within the
customer's site will not be allowed. Coastal Computing shall be the sole arbiter
of what is considered to be a high server usage level.
EXCESSIVE BANDWIDTH USAGE
The monthly bandwidth allowance is listed on your Plan's Feature
Page. We will monitor your bandwidth as necessary and will notify you
if your traffic is exceeding your allowance. Sites that exceed
the traffic limits will be charged 15 Euros per Gigabyte per month over
the monthly allotment for the Plan the customer has opted.
CHAT ROOMS
Coastal Computing does not allow clients to install their own chat rooms.
Chat rooms tend to be a large system hog and we cannot permit it as
an account option. Coastal Computing may provide chat rooms under certain
Plans (see comparison chart for availability) for free or a small extra
fee that should meet most users' needs and run without hindering the
performance of the servers. Non-Java chat rooms (cgi or perl based)
are not allowed.
BACKGROUND RUNNING PROGRAMS
Coastal Computing may allow programs to run continually in the background,
these programs will be considered on an individual basis and an extra
charge will be incurred based on system resources used and operational
maintenance needed. If you wish to run background programs please contact
us before doing so.
IRC
Coastal Computing does not allow IRC or IRC bots of ANY KIND, NO MATTER
HOW SMALL, to be operated on our servers.
MAIL CONFIGURATIONS
Coastal Computing supports e-Mail connectivity to our servers directly.
This means you specify POP3 and SMTP server names in your e-Mail client
to connect to us directly to receive e-Mail on behalf of your domain.
Any requests for MX record changes to support any other configuration
will result in additional charges.
FOREIGN DOMAIN REGISTRATIONS
Coastal Computing will host any domain from any foreign registry; however,
the user is responsible for the registration of any name not a .com,
.org, .net, .biz, .info or .edu domain. An .edu domain is for
accredited, degree granting educational institutions. EDU requests (if
you feel you warrant an .edu domain) are not guaranteed by Inland
Computing
and if not approved by the InterNIC you may be forced to obtain an .org
domain.
NET ABUSE USING E-MAIL
The sending of commercial advertising through e-Mail (AKA spamming)
from an Coastal Computing server, referring to a URL on an Inland
Computing server,
or using an e-Mail address that is maintained on a Coastal Computing server
is STRICTLY PROHIBITED. This includes but is not limited to activities
such as using a non-existent e-Mail return address on a commercial solicitation,
allowing spamming by third parties to promote a web site hosted by
Coastal Computing,
trolling (posting outrageous messages to generate numerous responses),
mail bombing (sending multiple messages without significant new content
to the same user), subscribing someone else to a mailing list without
that person's permission, cross posting articles to any newsgroup without
their permission, and commercial advertisements. In general, any kind
of commercial advertising in areas on the Internet not intended for
such purposes is prohibited. Government laws construed as protecting
this practice do not apply. If you are found to have spammed, then we
will immediately, without warning, terminate your account with no refund.
In addition, we will impose a 100 Euro penalty for each spam policy violation.
We reserve the right to refuse or cancel service to known spammers.
Lastly, we reserve the right to determine what violates this policy.
GENERAL NET ABUSE
Use of copyrighted material without first obtaining appropriate permission
from the copyright holder is in strict violation with local and
European laws,
and will not be tolerated within the web pages hosted by Inland
Computing. If
you are not an Coastal Computing customer, but believe an Inland
Computing customer is
in violation of one or more copyright laws, please immediately
e-mail us with the site URL and specifics of the material
believed to be in copyright violation. If the material proves to be
in copyright violation, we will allow the customer/site owner the opportunity
to immediately remove the material. If the material is not removed within
48 hours of notice of proven violation, we will disable the account
until the customer/site owner complies with our request to remove the
material.
Linking to another web site for content and/or graphics materials
is considered "bandwidth theft." While bandwidth theft may
not currently considered a European, country, or local law, Inland
Computing
does NOT allow such activity. If you have content that is being
directly linked on the pages of one of our customers and you have
not granted permission for such linkage, please immediately e-mail
us
with the site URL and specifics of the material being linked. We will
investigate the matter, and if a violation is indeed in existence, we
will allow the customer/site owner the opportunity to immediately rectify
the problem by removing direct links. If the material is not removed
within 48 hours of notice of proven violation, we will disable the account
until the customer/site owner complies with our request to remove the
material.
Any Coastal Computing client found to be in violation of either copyright
laws or bandwidth theft whose site is disabled due to non-compliance
within the stated 48 hour period will receive no refund whatsoever for
any downtime the site suffers as a result.
SERVER ABUSE
Any attempts to undermine or cause harm to an Coastal Computing server
or using an e-Mail address that is maintained on an Coastal Computing machine
is STRICTLY prohibited. We reserve the right to deactivate any script
(even our own) if it is used to such an extent that it poses a threat
to the performance of our network.
Any sub-networks of Coastal Computing must adhere to the above
policies. The failure to meet or follow any of the above guidelines
are grounds for immediate account deactivation. We reserve the right
to REMOVE any account (deactivated or not) within 10 days prior
notice except for spamming. which warrants immediate removal with no
refunds of monies paid to Coastal Computing
Complaints about violators of our policies should be referred to
us. Each complaint will be fully investigated. Coastal Computing reserves the right to fully investigate any reported violations
and to determine the proper consequences.
DOMAIN TRANSFER
We will submit an application to transfer your domain to our server.
Your (domain owner) responsibilities:
You must inform us if you have not received any e-Mail from InterNIC
to confirm the transfer of your domain within 2 days.
If you did not receive any confirmation email from InterNIC,
it may be because your original administrative e-Mail with InterNIC
is:
- no longer valid, or
- misspelled
It is your responsibility to make sure that the "Administrator" e-Mail
address that you register with InterNIC is correctly spelled and current.
Important: The "Administrator" e-Mail address that you register with
InterNIC is the only venue by which InterNIC can contact you, and it
will be used to confirm your domain transference request. If you misspell
this e-Mail address or have changed your e-Mail address without informing
InterNIC or Coastal Computing, your domain will not be transferred.
Important: Coastal Computing will not be responsible for any untransferred
domain due to invalid or incorrectly spelled e-Mail with InterNIC. If
your e-Mail is not a valid e-Mail or your domain didn't get transferred
within 7 days, you must contact us to let us know about this problem
for further assistance.
Note: Coastal Computing service will start from the day that we set up
your site, regardless of whether or not your domain gets transferred.
BILLING POLICY
You may elect billing by credit or debit card payment on the hosting
secure order form. All hosting fees are billed monthly on the
first day of each month and are payable in advance.
You will be notified via e-Mail if your account is in arrears due
to credit card refusal. If you change e-Mail address you
must inform us. If your account has been removed
due to non-payment, an 80 Euro reconnection fee will need to be paid plus
all monies due to make your account current (a deposit may be
required under these circumstances).
30 DAY MONEY BACK GUARANTEE
Our plans include a 30 day money back guarantee. If you are dissatisfied
with your service for any reason, you will receive a full refund if
you cancel your account within 30 days of the activation of your account.
Refunds for domain registration, if we perform the domain registration
service for you, are NOT available under any circumstances.
Any requests for cancellation must be received in writing via email,
regular mail or fax. Cancellations over the telephone are not accepted.
ALL OTHER REFUNDS
Coastal Computing does not refund for less than a 30 day period so if you
choose to cancel, the beginning of the next month will be considered
your cancellation date.
CANCELLATION
Coastal Computing requires any site cancellation to be informed in written
notice at least 14 days before the first day of the month. If
you cancel service with less than 14 days notice or after the due date,
Coastal Computing will charge the monthly fee for the following month.
These policies are subject to change without notice. Inland
Computing reserves
the right to refuse service to anyone or to deactivate any account at
our sole discretion. These conditions do not affect your
statutory rights.
